ለአንድ ሀገር ሰላም፣ ዲሞክራሲ፣ የሕግ የበላይነትና ፍትሕ መረጋገጥ እንዲሁም ሰብዓዊ መብቶች መከበር በሕግ አግባብ የተቋቋሙ ገለልተኛ፣ ነፃ፣ ተጠያቂነት ያለባቸው እና በሕዝብ ዘንድ አመኔታን ያተረፉ ፍርድ ቤቶች ሚና የጎላ እንደሆነ አያጠያይቅም፡፡ ያለሕግ እና ያለፍርድ ቤቶች ሰላም፣ ዲሞክራሲ፣ የሕግ የበላይነትና ፍትሕ በአንድ ሀገር ውስጥ ይኖራል ብሎ መገመት አይቻልም፡፡

ሰሞኑን የአቶ ጀዋር መሐመድን ኢትዮጵያዊ ዜግነት መልሶ የማግኘት ጉዳይ በኦፌኮ እና በምርጫ ቦርድ መካከል ክርክሮችን ማስነሳቱን በተለያዩ ማህበራዊ ሚዲያዎች እየሰማን እንገኛለን፡፡ በመሆኑም የዜግነት ሕጉ ኢትዮጵያዊ ዜግነት መልሶ ስለማግኘት ስላሰቀመጣቸው ቅድመ ሁኔታዎች እና ዜግነት መልሶ ማግኘት ስለሚረጋገጥበት መንገድ ያለኝን መረዳት ለማካፈል ወደድኩኝ፡፡

መግቢያ

የአዲስ አባባ ከተማ አስተዳደር ካቢኔ ቀደም ሲል አውጥቶት የነበረውና የተከራየን ሰው ማስወጣት (በርግጥ ደንቡ ይህን ድርጊት አልከለከለም) እና የኪራይ ዋጋን መጨመር ለማገድ የወጣውን የደንብ ቁጥር 122/13 ማራዘሙን በድጋሜ አስታዉቋል፡፡ ይህ ደንብ የቤት አከራዮች ያከራዬት ቤት ላይ ዋጋ እንዳንይጨምሩ ክልከላ ይጥላል፡፡ በዚህ አጭር ጽሑፍ የደንቡን ህጋዊነት ለሕግ የበላይነት ያለውን መጥፎ ተምስሌትነት በርግጥ ሊፈታ ያሰበውን ችግር ለመፍታት ያለውን ፋይዳ በአጭር ባጭሩ ለመዳሰስ ይሞክራል፡፡ አንባቢያንን ለተራዘመ እና አሰልቺ የንባብ ሂደቶች ላለመዳረግ ጉዳዩን በቀጥታና በጭሩ ለመዳሰስም ተሞክሯል፡፡

Introduction

The Federal Court Proclamation no 25/96 its amendment, which has been in force for many years, is repealed and replaced by the federal courts' Proclamation number 1234/2021.  When we look at the existing proclamation, the new law introduced new elements. In these short notes, we will briefly explore the new features of the proclamation and the reason behind the improvements of the proclamation to its current content.

ሰዎች ንብረታቸውን የሚመለከቱ ጉዳዮችን በተመለከተ አንድን ግዴታ ለማቋቋም ወይም ለመለወጥ ወይም ለማስቀረት ባላቸው ተወዳዳሪ ግንኙነት በሁለት ወይም በብዙ ሰዎች መካከል ስምምነት ሲፈፅሙ ውል እንዳደረጉ ከኢትዮጵያ የፍትሐብሄር ህግ ቁጥር 1675 መረዳት ይቻላል፡፡ አንድ ውል ከተደረገ በኋላ በአንደኛው ወይም በሁለቱም ተዋዋይ ወገኖች ላይ ግዴታን ይጥላል፡፡ ይህንን ግዴታ በተባለው ጊዜ አለመፈፀም ወይም ጊዜ ካልተቀመጠ ደግሞ ማዘግየት የሚያስከትለውን ኪሳራ በተመለከተ ተዋዋይ ወገኖች ገደብ ወይም ቅጣት ወይም አንድ የተወሰነ ወለድ ግዴታውን ያልፈፀመ ተዋዋይ ወገን ውሉን ላከበረው ወገን እንዲከፍል ሲዋዋሉ መመልከት ወይም በፍርድ ቤቶች ሲወሰን ማየት የተለመደ ጉዳይ ነው፡፡ በዚህም ምክንያት ወለድና የወለድ ወለድ (Interest on interest or compound interest) አስተሳሰብ ደንቦችን በተመለከተ እና ተያያዥ ጉዳዮችን የኢትዩጵያ ህጎች ላይ ተመስርተን በጨረፍታ እንደሚከተለው እንዳስሳለን፡፡

ከሰሞኑ በፌዴራል የመጀመሪያ ደረጃ ፍርድ ቤት ፍቺን በተመለከተ ለየት ያለ ውሳኔ ተሰጥቷል፡: ይህን ውሳኔ ለሕዝብ ይፋ ቢደረግ ጠቃሚ ሃሳብ እንዲሸራሸር ሊረዳ የሚችል ከመሆኑም በላይ ሕጉንም ለመፈተሸ ይረዳል በሚል አስተያየት ለአንባብያን ለማድረስ እሞክራለሁ፡፡ ጉዳዩ ይፋ ቢሆንም ይግባኝ ሊቀርብበት የሚችል በመሆኑ ለጊዜው የግለሰቦችን ስም ተቀይሯል፡፡ የጉዳዩ ዝርዝር ሁኔታውም ከዚህ በታች ባለው መልኩ ተቀምጧል፡፡

Before the enactments of the Federal Administrative Procedure Proclamation, there is a gap in the Ethiopian legal regime due to the absence of administrative procedure law. This is a neglected subject both by the legal academia and practitioners. It is very difficult and challenges to talk about the history of administrative law in Ethiopia. Administrative law is still not well developed, and it is an area of law characterized by the lack of legislative reform.

The Wednesday news report on Reporter News Paper Amharic about insurance companies restricting the commission paid to insurance agents is a dreadful, despicable thing. It shows what happens once a government fails to effectively and successfully to restrain firms.

In 2002, when I was doing my undergraduate degree, our contract law teacher started talking about period of limitation and its effect. I neither had a concept nor an argument about period of limitation under art 1845 of the civil code. I attended the whole class, tried to understand arguments, justifications and ration d’être of the period of limitation. Mulugeta Mengist, in his monograph says that period of limitation is used to ensure certainty and predictability in transactions.
